Notice on written contracts in 2026:
  • • Open-ended contract (sem termo): Can technically be verbal, but a written contract is strongly recommended to prove agreed hours, salary, and Social Security regime.
  • • Fixed-term contract (a termo): A written document is mandatory by law (Article 3 of Decree-Law No. 235/92). Without a written contract, the relationship is legally presumed to be permanent.

Is a written employment contract mandatory in Portugal?

As a general rule, an open-ended domestic employment contract in Portugal can be entered into verbally. However, without a written contract, it becomes very difficult to prove what was agreed in the event of a dispute over schedules, days off, or holiday pay. During an inspection by the Working Conditions Authority (ACT — Autoridade para as Condições do Trabalho) or in a labour dispute, the lack of written evidence almost always harms the employer, who bears the burden of proving compliance.

For fixed-term contracts (contratos a termo, whether temporary or replacement), Portuguese law explicitly requires a written contract stating the valid legal justification. If a written contract is missing, the law presumes the worker has an open-ended contract.

What changed in Portuguese domestic employment law?

The domestic service legal framework in Decree-Law No. 235/92 was significantly amended by Law No. 13/2023. This reform repealed several older special provisions and added Article 37-A, establishing the direct application of the main Labor Code (Código do Trabalho) for all matters not explicitly covered by the domestic service statute:

Special rules remain active regarding live-in vs live-out modalities (Article 7), in-kind benefits (Articles 9 and 10), maximum hours (Article 13), weekly rest (Article 15), and contract termination (Article 27).

O Empregador obriga-se a transferir para uma seguradora a responsabilidade por acidentes de trabalho do Trabalhador.

Cláusula 13.ª — Deveres das partes

As partes obrigam-se a respeitar os deveres decorrentes do contrato e da lei, designadamente os deveres de respeito mútuo, de assiduidade e pontualidade, de zelo e diligência, e de confidencialidade quanto à vida privada e aos dados pessoais do agregado familiar de que o Trabalhador tome conhecimento no exercício das suas funções.

Cláusula 14.ª — Cessação do contrato

O contrato cessa por acordo das partes, caducidade, despedimento com justa causa ou denúncia pelo trabalhador.

A caducidade do contrato a termo é comunicada por escrito pelo Empregador com a antecedência de 7 dias se o contrato durou até 6 meses, de 15 dias se durou de 6 meses a 2 anos, e de 30 dias se durou mais de 2 anos.

O Trabalhador que denuncie o contrato observa um aviso prévio de duas semanas por cada ano de serviço ou fração, até ao máximo de seis semanas.

Estando o Trabalhador alojado, dispõe de três dias para desocupar o alojamento.

Cláusula 15.ª — Lei aplicável

Em tudo o que não esteja expressamente previsto neste contrato aplica-se o Decreto-Lei n.º 235/92, de 24 de outubro, na sua redação atual, e, subsidiariamente, o Código do Trabalho.

How to complete each contract clause in English

Identification of the parties

Fill in full names, Tax ID numbers (NIF — Número de Identificação Fiscal), and residential addresses for both employer and worker, as well as the worker’s Social Security Number (NISS — Número de Identificação da Segurança Social). If a foreign worker does not yet have a NISS, Social Security registration must be requested before work begins.

Clause 1 — Scope and duties (Objeto)

Specify concrete duties (cleaning, cooking, laundry, childcare, or elderly care). Detailing tasks prevents future misunderstandings about whether new duties represent an unauthorized contract change.

Clause 2 — Workplace (Local de trabalho)

State the residential address where work will be performed. If work includes a secondary residence (e.g., a holiday home), include that address in the contract.

Clause 3 — Contract type and duration (Modalidade e duração)

An open-ended contract (sem termo) is the standard legal default. A fixed-term contract (a termo) is only valid for a genuine, temporary reason (e.g., maternity cover or temporary support) and cannot exceed 1 year in total duration. Also specify whether the role is full-time or part-time, and whether it includes board or lodging.

Clause 4 — Trial period (Período experimental)

The Labor Code applies: 90 days as a general rule, or 180 days for roles of special complexity or trust (such as caring for young children or dependents). During the trial period, either party may terminate without advance notice or severance pay (providing 24 hours to vacate if lodging is provided).

Clause 5 — Working hours and schedule (Período normal de trabalho e horário)

The statutory limit is 40 hours per week (Article 13). Indicate the days worked, start and end times, and meal break duration. For live-in staff, only actual working hours count toward the limit.

Clause 6 — Weekly rest and public holidays (Descanso semanal e feriados)

The law guarantees at least 1 weekly day of rest without loss of pay, preferably on Sunday (Article 15), as well as mandatory public holidays (Article 24).

Clause 7 — Salary and payment method (Retribuição)

State the monthly gross wage. In 2026, the minimum gross wage in mainland Portugal is €920.00 per month for 40 hours per week (or the proportional equivalent for part-time). Payment by bank transfer is strongly recommended to maintain proof of payment.

Clause 8 — In-kind benefits (Prestações em espécie)

If food or lodging is provided as part of remuneration (Article 9), the law requires that their cash equivalent value be explicitly stated in the contract (Article 10, paragraph 3) for calculating holiday pay and allowances.

Clause 9 — Holiday and Christmas allowances (Subsídios de férias e de Natal)

Both allowances equal one full month’s base salary. The Christmas allowance must be paid by 15 December.

Clause 10 — Annual leave (Férias)

The worker is entitled to 22 working days of paid annual leave per year, scheduled by mutual agreement.

Clause 11 — Social Security (Segurança Social)

Identify the agreed contribution regime: Conventional (regime convencional, rates on the IAS base of €537.13) or Real (regime real, rates on actual earnings). The Real regime requires a written contract and medical certificate.

Clause 12 — Workplace accident insurance (Seguro de acidentes de trabalho)

Workplace accident insurance is compulsory by law and must be active prior to the worker’s first working day.

Clause 13 — Duties and confidentiality (Deveres e confidencialidade)

Establishes mutual respect, punctuality, diligence, and strict confidentiality regarding the household’s private life and personal data.

Clause 14 — Termination and notice periods (Cessação e aviso prévio)

Sets statutory notice periods for fixed-term contract expiration (7 to 30 days) and for resignation by the worker (2 weeks per year of service, up to a maximum of 6 weeks).

  1. Register the hire on Social Security Direct (Segurança Social Direta): Must be submitted prior to the start of employment.
  2. Declare the contribution regime: Choose Conventional or Real (attaching the written contract and medical certificate if opting for Real).
  3. Take out workplace accident insurance: Mandatory before the worker performs their first day of work.

Common mistakes to avoid

  • Using a fixed-term contract without a written document: Automatically converts the contract into a permanent open-ended contract.
  • Failing to state the cash value of food and lodging: Prevents proper calculation of allowances and tax deductions.
  • Delaying workplace accident insurance: Leaves the employer personally liable for medical and compensation costs from day one.
  • Not keeping a signed original copy: Both employer and worker must hold an original signed copy.
